Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Birdie or Bust application or website (the “Service”), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

These Terms apply to all users, including players, event organizers, and visitors.

2. Eligibility

You must be at least 13 years old to use Birdie or Bust. Event registration and payment features may require users to be at least 18 years old or have parental consent.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials.

• Do not share your login information.
• Do not impersonate another person.
• Do not create accounts without permission.
• Notify us immediately of unauthorized access.

4. Player Rules

• Submit accurate scores and gameplay data.
• Do not manipulate or falsify scoring results.
• Respect players, organizers and course staff.
• Follow event-specific rules.
• Use GPS and yardage tools responsibly.

5. Organizer Rules

• Provide accurate event details.
• Honor confirmed registrations.
• Comply with applicable laws.
• Maintain accurate course data.
• Operate events fairly and honestly.

Birdie or Bust acts solely as a technology platform and is not responsible for organizer-run events, prizes, refunds, cancellations, or course conditions.

6. Payments & Refunds

Player Payments

Event entry fees are processed at registration. Fees are generally non-refundable except where required by law or event cancellation.

Organizer Payouts

Entry fees are distributed to organizers minus applicable platform fees within five business days of event completion.

Disputes

Billing disputes must be reported within 30 days.

7. Intellectual Property

The Birdie or Bust name, branding, platform, scoring technology, and software are owned by Birdie or Bust, Inc.

You may not copy, distribute, modify, reverse-engineer, or exploit any part of the Service.

Content you submit remains your property, but you grant Birdie or Bust a non-exclusive license to use and display it for operation of the Service.

8. Prohibited Conduct

• Violating laws or regulations
• Harassment or abuse of users
• Manipulating scores or rankings
• Unauthorized scraping or data extraction
• Introducing malware or harmful code
• Unauthorized system access attempts
• Unauthorized commercial use

9. Disclaimers

Birdie or Bust does not guarantee uninterrupted service, complete accuracy of scoring data, or error-free operation.

GPS and yardage information is provided for convenience only and may not reflect exact course conditions.

10. Limitation of Liability

To the maximum extent permitted by law, Birdie or Bust shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Service.

Our total liability shall not exceed the greater of $100 USD or the amount paid to Birdie or Bust during the previous 12 months.

11. Indemnification

You agree to indemnify and hold harmless Birdie or Bust, its employees, officers, partners, and affiliates from claims arising from your use of the Service, violation of these Terms, or events organized through the platform.

12. Termination

We may suspend or terminate accounts that violate these Terms, engage in fraud, or misuse the platform.

You may delete your account at any time through Settings → Account → Delete My Account.

13. Governing Law

These Terms are governed by the laws of the State of California without regard to conflict of law principles.

Any disputes shall be resolved in the courts located in San Francisco County, California.

14. Changes to Terms

We may update these Terms periodically. Material changes will be communicated through email and in-app notifications at least 14 days before taking effect.
